How Cases Should Be Decided Essay From the discussions and court observations, it is my considered view that decisions of cases filed in court should be best determined by the application of judicially defined principles and legislative enactments and should not merely depend on ad hoc decisions made by juries. The concept of jury trial is as old as humanity. It is basically a proceeding in which decisions and findings of facts of a given case are determined by a jury. Juries, upon the other hand are selected to represent the cross-sections of the community (Hale Star V, McCormick, 2000, p. 20-21). Thus, juries are often regarded as â€Å"peers of the accused† because they belong to the same community where the accused also lives. Jury trial are designed to provide a means of interjecting community norms and values to the judicial proceedings by providing opportunities for the members of the community to validate and test the applicability of the communities statute. However, in today’s generation, taking into consideration the major changes in our society and including its emerging complexities, I posit that the jury system failed to catch up to the judicial needs of cases filed before the courts of justice. It is my considered view that decisions arrived by juries are no longer that applicable in today’s generation because I believe that the justice system should be composed of people who have deep knowledge and experience in the field of law. By using the jury system we are in fact placing the burden of judgment on the mind of an average and untrained citizen. Often times, persons selected as jurors have no legal expertise. In my visit to courts, I observed that the jurors are average citizens and I doubt if they really have an in depth knowledge in law and jurisprudence. Thus, having no sufficient legal knowledge, they can get easily swayed and persuaded by clever lawyers who trained themselves to confuse and mislead the jurors through their colorful languages and speeches. Another reason why I aver that decisions should no longer be placed to the hands of a jury is that, jurors have the tendency to be swayed by prejudice through application of racial considerations, gender orientations and biases. In the court trial I saw, I observed that the jurors are not at all diverse in race, sex or age. Thus, the fate of an accused or the person in court is left to the hands of a layman that is often guided by his own personal biases and beliefs regarding his own creed, religion, sex, age and race. Lastly, I believe that the jury system is no longer viable in today’s courts because of the realities that are present in the system, which is the picking of the jury is no longer as objective as it were before. Thus, more often we end up with jurors, just like the juries I have seen in my visit to courts, to be bored, without interest and just sitting there. Worthy taking note that the integrity of judiciary rests not only upon the fact that it is able to administer justice but also upon the perception and confidence of the community that the people who run the system have done justice. At times, the strict application of law may in fact, do justice but it may not necessarily create confidence among the people that justice indeed is served. Hence, in order to create such confidence, the people who run the judiciary, particularly the person or the people who will hear and decide the case, must not only be proficient in both the substantive and procedural aspects of the law but most importantly, they must possess the highest integrity, probity and unquestionable moral uprightness, both in their public and private lives. Then and only then, can the people, including the writer, be reassured that the wheels of justice in our country run with fairness and equity, thus, creating confidence in the judicial system. The Watergate Scandal :: President Richard Nixon

The tapes The hearings held by the Senate Watergate Committee, in which Dean was the star witness and in which many other former key administration officials gave dramatic testimony, were broadcast through most of the summer, causing devastating political damage to Nixon. The Senate investigators also discovered a crucial fact on July 13: Alexander Butterfield, deputy assistant to the President, revealed during an interview with a committee staff member that a taping system in the White House automatically recorded everything in the Oval Office—tape recordings that could prove whether Nixon or Dean was telling the truth about key meetings. The tapes were soon subpoenaed by both Cox and the Senate. Nixon refused, citing the theory of executive privilege, and ordered Cox, via Attorney General Richardson, to drop his subpoena. Cox's refusal led to the "Saturday Night Massacre" on October 20, 1973, when Nixon compelled the resignations of Richardson and then his deputy in a search for someone in the Justice Department willing to fire Cox. This search ended with Robert Bork, and the new acting department head dismissed the special prosecutor. Allegations of wrongdoing caused Nixon to famously state "I am not a crook" in front of 400 Associated Press managing editors at Walt Disney World in Florida on November 17. While Nixon continued to refuse to turn over actual tapes, he did agree to release edited transcripts of a large number. These largely confirmed Dean's account, and caused further embarrassment when a crucial, 18Â ½ portion of one tape, which had never been out of White House custody, was found to have been erased. The White House blamed this on Nixon's secretary, Rose Mary Woods, who said she had accidentally erased the tape by pushing the wrong foot pedal on her tape player while answering the phone. However, as photos splashed all over the press showed, for Woods to answer the phone and keep her foot on the pedal involved a stretch that would have challenged many a gymnast. She was then said to have held this position for the full 18Â ½ minutes. Later forensic analysis determined that the gap had been erased several—perhaps as many as nine—times over, refuting the "accidental erasure" explanation.. This issue of access to the tapes went all the way to the Supreme Court and on July 24, 1974 the Court unanimously ruled in United States v. Nixon that Nixon's claim of executive privilege over the tapes was void and they further ordered him to surrender them to special prosecutor Leon Jaworski.

According Kotler and Keller theory, a company has 4 choices when it comes to brand strategy. Apple’s continuous  with line extension in recent years, such as the IPhone 3 development to the iPhone 4s. In addition, they also focus on brand extension e.g. IPod music player, MacBook, and IPad. (Kotler and Keller, 2011, p.260-261) Constant innovation will affect consumers become more eager to get better items. Apple’s was stimulated the certain product by implementing new design, operability, and user-friendly features. (Shane, 2010, p.13-19) Price Price is the amount of money paid by consumers in order to obtain goods and services. It is the most flexible marketing mix tools compared to the other three P because it can be changed according to certain situations. (Kotler and Armstrong, 2006, p.290) For example, price can change to low when serve a familiar customer. The era of the telegraph, telegraph monopoly by one company and demand more than supply. The absence of competitors, the level of prices is actually not greater impact on consumer decision-making. (Anonymous, 2010) In fact, the telegraph has reached maturity which mean successfully to maximize profit and maintain the market share, but in the end cannot be avoided the market penetration by new technology such as telephone and fax. There are a lot of competitors, the price must be reduced, and consumers will give priority to their own economic situation and needs. For example, the MacBook is very expensive, but other brands have the same technology, but the price is low, then the Apple will lose in price. In fact, there are many factors to help Apple successful, such as, iPhone does not have the driving force without internet, or, people do not have high purchasing power in less advanced country, Place Place refers to urban and suburban whereby goods and services are made available to customer. Marketers were took my benefits packed into the marketing mix to make a profit e.g. health care products. In fact, the benefits also allow employers to solve some problems, that is, reduce the employee’s work attitude. Some unemployed tradesmen are quite willing to interview, but less than enthusiastic about taking a job. In fact, every company’s marketing strategy will directly affect the employees’ attitude, such as the company’s tactics cannot growth the profit, so will make employee lose fighting spirit. Sales will be able to enhance the employee’s salary, which is the best reason to convince the employees. If the company is not profitable, the employee is no longer rescued by the employer. Some people believe that the price of one ringgit is difficult to obtain more profit, but the global populations are more than 6.9 billion, if one person to eat an apple a day, if an apple earns 0.01 pounds, the employer successful to earn 69million. If the employer with a high brand image, employee can be proud to work in the  company. Thirdly, apple can sell all over the world can affect the employment rate. Some places cannot grow apples, but the employer can transfer the apple to the country with the advance of technology e.g. keep fresh and air transportation. The finally is promotion. â€Å"An apple a day keeps the doctor away’, I believe everyone knows the proverb. There is no doubt that it was enough to affect the consumers of existing and next generation, and only need the proverb advertising to remind the consumers to buy it. Apple’s low has been reached maturity, unless it was confirmed that the Apple bringing harmful, otherwise the employee will agree that the business opportunity of apple will not be end. (Matt Michel, 2010) c)  Admittedly, I have many benefits but also have a negative side. Apple skin can protect the pulp of fresh, but if it loses the apple skin, the pulp will become no nutrition and broken just in ten minutes, so consumers must be finish it in short time. Of course, the solution is placed the flesh in the water contains antioxidant, so apple can maintain and extend the nutrition of the flesh, but this is only a temporary solution, it is best to immediately eat. Apple is a natural plant items, Apple can improve people’s health, which is the largest business opportunities. Advances in Operating Systems

Operating systems have undergone a series of evolutions since the early nineteen fifties when they first appeared in the market. By this time they were crude and they performed limited duties with great difficult. They also consumed time and were extremely annoying.When it struck the year 2000, computer operating systems finished half a century in existence. The efficient systems that entered the scene in the nineteen nineties are a successor to the batch processing systems of the early nineteen fifties.Just like the operating systems have undergone much evolution since they were first invented, the definition has also had to change from time to time so as to fit the moment. The nineteen sixties had the world defining operating systems as the software that was responsible for the direction or control of the hardware.The emergence of microcode has shifted the definition and nowadays operating systems are defined as the software whose duty is to make the hardware possible to use. Opera ting systems comprises a set of programs that basically control the computer. Abbreviated as OS or O/S, operating systems form the software component of a computer that handles the coordination and management of computer resources.It also controls the sharing of the computer resources by acting as a host of the applications that are carried out or done in the computer. It is true that no computer functions in the current world of computers without making use of an operating system.This applies to handheld computers, desk top computers, video game consoles and super computers. The batch processors mentioned above that were the forerunners of current operating systems were produced by a couple of companies such as UNIVAC and Control Data Corporation.Components of an operating systemOperating systems are composed of different areas such as kernel services, library services and application level services. Kernel services are charged with the responsibility of providing a path to the per ipheral components or devices.Usually, the kernel answers the device interrupts and responds to service requests from the processes taking place. I t is the core of the operating system and functions in a privileged manner that supports the execution of orders from the hardware. Library services in the operating system deals with the storage of no-processed and processed data. This is retrievable for use in future in case it is required for reference or processing.The other component of the operating system is the application services part or component whose function is primarily to coordinate the running of the application area of the system.The historical progression or advancement of operating systemsSince the period of the batch systems, so much has happened in the world of computer operating systems. The most productive period in computer operating systems evolution took place in the sixties and seventies. This is the time when much of the now famous and widely used and highly effective computer operating systems were invented.The earliest operating systems or the so called classic operating systems came out in distinct times. These times can be broken down to a number of phases. The first phase is the open shop which saw the introduction of the IBM 701 open shop. The period in which this came out was the year nineteen fifty four.The batch processing period gave us the batch processing phase that went a head to bring forth the well known BKS system. This was the year nineteen sixty one. The batch processing phase was followed by the multiprogramming phase .This phase was responsible for the production or invention of up to four serious operating systems. These systems were the atlas supervisor in nineteen sixty one, the B5000 system in nineteen sixty four, the exec II system in nineteen sixty six and the egdon system that came out in the year nineteen sixty six as well.The fourth phase in this line of classic operating systems was the timesharing phase. T his phase saw the emergence of operating systems such as CTSS that came out in nineteen sixty two, the multics file system that came out in the year nineteen sixty five, and the titan file system that was produced in nineteen seventy two.The UNIX operating system that came out in nineteen seventy two also falls into the timesharing category.Still on the idea of operating system production and functional phases, the timesharing phase pushes us on to the concurrent programming phase. At this angle, a number of operating systems are recognized.These include the solo program text of nineteen seventy six, the solo system of nineteen seventy six, the THE system that came out in nineteen sixty eight, the Venus system that came out in nineteen seventy two, the RC 4000 that was invented in the year nineteen sixty nine and the boss 2 system that was produced in the year nineteen seventy five.The concurrent programming phase is closely followed by the personal computing phase .In this particul ar phase, operating systems that are still highly respected in the world of computing such as the star user interface produced in nineteen eighty two, the operating system produced in nineteen seventy two simply referred to as the OS, the alto system of nineteen seventy nine and the pilot system of nineteen eighty are highly considered.Then there is the last phase which is the phase of distributed systems. The distributed systems that are found in this phase include the highly admired and valued Unix United System that came out in nineteen eighty two, the amoeba system of nineteen eighty, and the Unix United RPC system that appeared in the world of computing in the year nineteen eighty two.There is also the WFS file server system that was produced in the year nineteen seventy nine.In the world of evolution of operating systems, there are strong principles that always dictate the nature and operational capability of an operating system. These basic ideas or principles are the ones th at always lead to the rise or invention of the technical benchmarks that led to the design of the operating systems in question.The history of computer operating system evolution is littered with these basic ideas that gave rise or formed the ground for the formulation of the operating systems we now know and use. These basic ideas or core ideas of operating systems developed through phases as well just like the operating systems themselves.These phases include the open shop, the batch processing phase, the multiprogramming phase, the timesharing phase, the concurrent programming phase, the personal computing phase, and the distributed systems phase.The technical ideas that emerged during these phases include the remote servers that came out in the phase of the distributed computer operating systems, the simultaneous user interaction and the online file systems that came out during the phase of timesharing, and the graphic user interfaces that came out in the group of personal compu ter operating systems emergence.The parallel programming concepts, the extensive kernels, the secure parallel languages and the hierarchical systems as technical ideas also came out during the phase of concurrent programming.Added to these, are idea of operating systems itself that came out in the phase of open systems, the technical element of tape batching and first in and first out scheduling that emerged at the time of batch processing, the technical ideas of demand paging, priority scheduling, remote job entry, input –output spooling, processor multiplexing and indivisible operations that arose at the hot period of multiprogramming (Aho, 1984).Moving from the period of technical ideas innovation or invention, the history of operating systems also covers the mode or way of operation that was normally used in the process of trying to get work done using the poorly designed operating systems.At the time of the IBM open shop, life with the computers of the time was terribly hard and a long time was spent trying to achieve some simple targets. Workers would sit before computers waiting for their data to be processed to whatever they wanted. The problems posed by the computers of the time made the users work hard to come up with more efficient machines.The batch processing systems mentioned elsewhere in this research paper came as a serious leap forward in the evolution of operating system. Here, the idea of computers handling the amount of work to process came up and the laziness and slow nature of human beings was eliminated.Magnetic tape was input with punched cards and the jobs to be done were run in order of appearance through the computers .Satellite computers printed the output in a line printer and produced the next input.Despite the effectiveness that came with the batch processing system, there was the limitation of feeding the magnetic tape, the speed of output and the delay due to the sequential nature of the magnetic tapes. It would actually take several hours, a day or two before one would get the output for their work.This system of batch processing was followed by the BKS system that was very easy to read even by people who were not so much into computer work and obviously had the same problem of delaying just like the batch processing.

Overview of OLED Technology OLED stands for organic light-emitting diode and its cutting edge technology results from many innovations in display monitors, lighting, and more. As the name suggests, OLED technology is the next-generation advance of regular LEDs and LCDs, or liquid crystal displays. LED Displays Closely related LED displays were first introduced to consumers in 2009. LED television sets were much thinner and brighter than their predecessors: plasmas, LCD HDTVs, and, of course, the humongous and outdated CRTs, or cathode-ray tube displays. OLED displays were introduced commercially a year later, and allow for even thinner, brighter, and crisper displays than LED. With OLED technology, completely flexible screens that can fold or roll up are possible. Lighting OLED technology is exciting because it is a viable and functional innovation in lighting. A lot of OLED products are light panels whose large areas diffuse lighting, but the technology lends itself well to different applications like the ability to change shape, colors, and transparency. Other benefits of OLED lighting compared to traditional alternatives includes energy efficiency, and the lack of poisonous mercury. In 2009, Philips became the first company to manufacture an OLED lighting panel called Lumiblade. Philips described the potential of their Lumiblade as thin (less than 2 mm thick) and flat, and with little heat dissipation, Lumiblade can be embedded into most materials with ease. It gives designers almost limitless scope to mold and meld Lumiblade into everyday objects, scenes and surfaces, from chairs and clothing to walls, windows and tabletops. In 2013, Philips and BASF combined efforts to invent a lighted transparent car roof. It will be solar powered, and will turn transparent when switched off. Thats just one of many revolutionary developments possible with such state-of-the-art-tech. Mechanical Functions and Processes In the simplest of terms, OLEDs are made from organic semiconductor materials that emit light when an electrical current is applied. OLEDs works by passing electricity through one or more incredibly thin layers of organic semiconductors. These layers are sandwiched between two charged electrodes–one positive and one negative. The â€Å"sandwich† is placed on a sheet of glass or other transparent material which, in technical terms, is called a â€Å"substrate†. When current is applied to the electrodes, they emit positively and negatively charged holes and electrons. These combine in the middle layer of the sandwich to create a brief, high-energy state called â€Å"excitation†. As this layer returns to its original, stable, â€Å"non-excited† state, the energy flows evenly through the organic film, causing it to emit light. History OLED diode technology was invented by researchers at the Eastman Kodak company in 1987. Chemists Ching W. Tang and Steven Van Slyke were the principal inventors. In June 2001, Van Slyke and Tang received an Industrial Innovation Award from the American Chemical Society for their work with organic light-emitting diodes. Kodak released several of the earliest OLED-equipped products, including the first digital camera with a 2.2-inch OLED display with 512 by 218 pixels, the EasyShare LS633, in 2003. Kodak has since licensed its OLED technology to many companies, and they are still researching OLED light technology, display technology, and other projects. In the early 2000s, researchers at Pacific Northwest National Laboratory and the Department of Energy invented two technologies necessary to make flexible OLEDs. First, Flexible Glass an engineered substrate that provides a flexible surface, and second, a Barix thin film coating that protects a flexible display from harmful air and moisture.
